In this policy, “we”, “us” and “our” mean the warranty provider identified above.
1. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits of this warranty are additional to your other rights and remedies under applicable law. Nothing in this policy excludes, restricts or modifies those rights.
The two-year period applies to this voluntary warranty only. Your rights under Australian Consumer Law may continue after it expires.
2. What this warranty covers
We warrant that new Paradox Movement furniture purchased directly from us or an authorised retailer in Australia will be free from defects in materials and workmanship for two years from delivery or collection.
This warranty covers manufacturing defects that appear during that period when the furniture is used for its intended purpose and reasonably cared for. Coverage includes defects in frames, joints, components, upholstery construction and applied finishes attributable to faulty materials or workmanship.
Made-to-order, customised and discounted furniture receives the same coverage, except for a particular defect expressly disclosed before purchase.
3. Intended use and care
Use the furniture for the purpose and environment described at the time of purchase. Follow reasonable assembly, use and care instructions supplied with it, including any stated load limits.
Unless identified as suitable for outdoor or commercial use, our furniture is intended for indoor residential use.
Failure to follow an instruction does not automatically void the entire warranty. An exclusion applies only to the extent that the failure caused or contributed to the problem.
4. What this voluntary warranty does not cover
This warranty does not cover:
- Ordinary wear consistent with the furniture’s age and reasonable use, including gradual cushion softening, fabric pilling, surface abrasion and normal patina.
- Damage caused by accidents, impacts, dragging, overloading, misuse, pets or other external causes.
- Damage caused by inappropriate cleaning products or care inconsistent with reasonable instructions supplied with the furniture.
- Damage caused by exposure to excessive heat, moisture, sunlight or weather beyond the conditions for which the furniture was represented as suitable.
- Damage caused by incorrect assembly, alterations, repairs or transport undertaken by you or a third party for whom we are not responsible.
- Damage caused by commercial, outdoor or other use for which the furniture was not represented as suitable.
- A specific defect expressly disclosed before purchase, in respect of that disclosed defect only.
- Change of mind, including a preference for a different size, colour or style where the furniture matches the agreed order and description.
These exclusions do not apply to the extent that the problem results from a covered defect, our actions, or the actions of someone for whom we are responsible. They do not limit remedies available under Australian Consumer Law.
5. Natural materials and handmade finishes
Timber, stone, leather, concrete and other natural or handmade materials may vary in grain, tone, texture, veining and appearance. Some materials develop patina or respond to normal environmental changes.
These characteristics are not manufacturing defects where they are consistent with the agreed description or sample, reasonable expectations for the material, and the furniture’s safety, durability and intended function.
We assess cracking, splitting, warping, discolouration and similar changes individually. A problem is not excluded simply because the furniture contains natural materials or is handmade.
6. How to make a claim
Email studio@paradoxmovement.com, telephone 0402 549 267, or write to Paradox Movement, 50 Reilly Lane, Sydenham NSW 2044.
Please provide:
- Your name and contact details.
- Proof of purchase, such as an invoice, order confirmation or other reasonable evidence.
- The product name and delivery or collection date, if known.
- A description of the problem and when you first noticed it.
- Photographs or video where reasonably practicable.
Please notify us promptly after discovering a problem. For this voluntary warranty, the defect must first appear within the two-year period. A reasonable delay in reporting it will not, by itself, invalidate your claim.
Stop using the furniture if continued use could be unsafe or worsen the damage. Please contact us before arranging repairs or returning large items so we can coordinate assessment and transport. This request does not remove any right to arrange a remedy under Australian Consumer Law.
Warranty registration and original packaging are not required.
7. Assessment and remedies
We may reasonably inspect the furniture, request further information or arrange assessment by a suitable repairer. Please provide reasonable access and cooperation.
For a covered defect, we will, at our cost and within a reasonable time, repair the affected component or furniture, replace it with an equivalent component or product, or provide a refund.
Our choice of remedy under this voluntary warranty is subject to your rights under Australian Consumer Law. Where you are entitled to choose a refund or replacement for a major failure, we will respect that choice. Other statutory remedies remain available where applicable.
We will explain our assessment. If we decline a claim, we will provide the reason and consider additional information you supply.
Any substitute product or materially different finish will be agreed with you. Repairs and replacements must meet applicable legal requirements. Statutory rights also apply to replacement goods and repair work.
8. Transport and claim expenses
For a valid warranty claim, we will pay reasonable costs necessary to assess and remedy the covered defect, including parts, labour and necessary transport.
For large, heavy or difficult-to-transport furniture, we will arrange collection or an on-site assessment where appropriate.
To request reimbursement of reasonable claim expenses, email or write to us using the details above. Include proof of payment and an explanation of the expense. Please discuss proposed expenses with us first where practicable. Prior approval is not a condition of reimbursement where the law requires us to pay.
If assessment establishes that there is no covered defect and no remedy is required under Australian Consumer Law, we may offer a paid repair. Any inspection, collection or repair charge must be explained and agreed with you beforehand. We do not charge a fee simply for making a claim.
9. Purchases through retailers
If you purchased through an authorised retailer, you may contact that retailer or us about this warranty.
This policy does not remove the retailer’s responsibilities under Australian Consumer Law or require you to pursue a manufacturer instead of the seller.
10. Questions and unresolved claims
If you disagree with an assessment, contact us and ask for a review. Include any additional information you would like considered.
You may also seek assistance from your state or territory consumer protection agency or pursue any other remedy available under law.
Later changes to this policy will not reduce the warranty benefits provided with an existing purchase.
